These Terms & Conditions apply to products and services supplied by Habitat & Hues Limited (“Habitat & Hues”, “we”, “us” or “our”).

Please read these terms carefully before accepting a quotation or placing an order with us.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

We provide made-to-measure curtains, blinds, tracks and related measuring, supply, delivery and installation services.

2. Quotations

Our quotations are prepared based on the information available to us at the time, which may include:

  • floor plans;

  • photographs;

  • approximate measurements;

  • customer specifications;

  • fabric selections;

  • track or blind requirements; and

  • information obtained during consultation.

Where a quotation is provided before an on-site measurement, it may be an estimate.

The final price may change if:

  • measurements differ from those originally supplied;

  • the scope of work changes;

  • additional windows or products are added;

  • a different fabric, track, blind or specification is selected;

  • site conditions require additional work or materials; or

  • you request changes after the original quotation.

We will inform you of material price changes before proceeding with additional work.

3. Measurements

Where Habitat & Hues carries out an on-site measurement, we will use reasonable care and skill in measuring the relevant areas.

You are responsible for ensuring that we have access to all relevant windows and areas during the measurement appointment.

If you provide your own measurements and ask us to manufacture products based on them, you are responsible for ensuring that those measurements are accurate.

We will not be responsible for fitting issues caused solely by inaccurate measurements supplied by you or another third party.

4. Fabric and Product Selection

You are responsible for confirming your final selection of:

  • fabrics;

  • colours;

  • curtain headings;

  • linings;

  • blinds;

  • tracks;

  • poles;

  • motors;

  • controls; and

  • other relevant specifications.

We encourage customers to view physical fabric samples wherever possible before confirming an order.

Colours may appear differently depending on:

  • natural and artificial lighting;

  • screen settings;

  • surrounding furniture and finishes; and

  • differences between digital photography and the physical fabric.

Images shown online or electronically should therefore be treated as a guide rather than an exact colour representation.

5. Natural Fabric Variations

Textiles are natural or manufactured materials that may display minor variations between samples and finished products.

Depending on the fabric, these may include variations in:

  • shade;

  • weave;

  • texture;

  • slubs;

  • pattern placement;

  • surface appearance; and

  • the way the fabric hangs.

Reasonable variations of this nature are not necessarily defects.

Fabric may also react naturally to temperature, humidity, sunlight and use over time.

6. Placing an Order

An order becomes binding once:

  • you have confirmed the relevant quotation or specification; and

  • any payment required to commence the relevant stage of the project has been received.

Your quotation, invoice, written specification and these Terms & Conditions together form the agreement between you and Habitat & Hues.

Where there is a conflict between these Terms & Conditions and a specifically agreed written term in your quotation, the specifically agreed term will normally take priority.

7. Payments

The payment schedule applicable to your project will be set out in your quotation, invoice or other written confirmation.

Payments must be made by the due dates shown.

We may delay:

  • ordering materials;

  • commencing production;

  • arranging delivery; or

  • arranging installation

until the relevant payment has been received.

Ownership of products supplied by us remains with Habitat & Hues until all amounts due under the relevant order have been paid in full, to the extent permitted by law.

8. Deposits

Where a deposit is required, it secures your project and allows us to begin work associated with your order, which may include consultation, measurement, design preparation, administration, sourcing materials or preparing bespoke production.

Once we have incurred costs or commenced work specifically for your project, some or all of a deposit may no longer be refundable, subject always to your statutory rights and applicable consumer law.

Any cancellation request will be considered in accordance with the nature of the order, the work already undertaken, costs already incurred and applicable law.

9. Bespoke and Made-to-Measure Products

Most Habitat & Hues products are made specifically for an individual customer using measurements and specifications agreed for their property.

These may include:

  • made-to-measure curtains;

  • made-to-measure blinds;

  • made-to-measure tracks;

  • altered or specially configured products; and

  • products ordered or manufactured to a customer's particular specification.

Once bespoke manufacture, alteration or ordering has begun, it may not be possible to cancel or change the order.

Where applicable consumer legislation excludes standard cancellation rights for goods made to a customer's specification or clearly personalised, that exclusion may apply to the bespoke goods in your order.

This does not affect your statutory rights where goods are faulty, not as described or otherwise fail to meet applicable legal requirements.

10. Changes After Confirmation

Please check your quotation and final specifications carefully before confirming your order.

If you request a change after confirmation, we will try to accommodate it where reasonably possible.

However:

  • a change may not be possible once materials have been ordered or production has begun;

  • additional costs may apply;

  • production or installation dates may change; and

  • materials already ordered or bespoke work already completed may still need to be paid for.

We will advise you of any significant additional charge before proceeding with an agreed variation.

11. Production Times

Our typical production period may be indicated in your quotation or communications with us.

Any production or installation timeframe we provide is an estimate unless we expressly agree a fixed date in writing.

Timing may be affected by matters including:

  • fabric availability;

  • bespoke manufacturing requirements;

  • custom trims or components;

  • supplier availability;

  • shipping or logistics;

  • property readiness;

  • access;

  • changes requested by you; and

  • circumstances outside our reasonable control.

We will use reasonable efforts to keep you informed if we become aware of a significant delay.

12. Delivery and Installation

Where installation is included in your order, we will arrange a suitable installation appointment once the products are ready and the relevant payments have been made.

You must ensure that:

  • we can safely access the property;

  • the relevant rooms and windows are accessible;

  • suitable parking or building access arrangements are made where required;

  • any necessary permissions have been obtained;

  • building work that could interfere with installation has been completed; and

  • the installation area is reasonably safe and ready for our team.

If installation cannot proceed because the property is not ready or access has not been provided, we may need to rearrange the appointment and reasonable additional costs may apply.

13. Walls, Ceilings and Existing Structures

Curtain tracks, blinds and related products require suitable fixing points.

Unless specifically agreed otherwise, we are entitled to assume that walls, ceilings, window surrounds and other relevant structures are capable of accepting ordinary curtain or blind fixings.

We are not responsible for hidden defects or conditions that could not reasonably have been identified before installation, including:

  • concealed pipework;

  • concealed electrical cables;

  • unusually weak or defective substrates;

  • hidden structural issues;

  • asbestos or hazardous materials; or

  • defects in previous construction work.

If we discover a condition that makes installation unsafe or unsuitable, we may stop work and discuss an alternative solution with you.

Additional work outside the agreed curtain or blind installation may require a separate contractor and is not included unless expressly stated in our quotation.

14. Electric Tracks and Motorised Products

Electric or motorised products may require:

  • an appropriate power supply;

  • electrical preparation;

  • compatible control systems; or

  • other work outside our standard installation service.

Unless expressly included in our quotation, electrical wiring, new power supplies and building works are not included in our services and should be carried out by an appropriately qualified person.

Compatibility with third-party smart-home systems is not guaranteed unless specifically confirmed in writing.

15. Inspection Following Installation

We encourage you to inspect the completed work as soon as reasonably practical following installation.

If you believe there is a problem, please contact us promptly and provide reasonable details, photographs or other information that will allow us to investigate.

Where there is a genuine defect for which we are responsible, we will assess the appropriate remedy in accordance with your statutory rights.

16. Quality Guarantee

Unless otherwise stated in writing, Habitat & Hues provides a one-year quality guarantee on our workmanship from the date of installation.

This guarantee is in addition to, and does not replace or limit, your statutory rights.

The guarantee does not cover damage or deterioration caused by matters such as:

  • misuse or accidental damage;

  • alterations by another person;

  • improper cleaning or treatment;

  • normal wear and tear;

  • excessive moisture or unsuitable environmental conditions;

  • building movement;

  • structural defects;

  • damage caused by pets;

  • third-party electrical or building work; or

  • failure of a third-party product outside the scope of our responsibility.

Manufacturer warranties may also apply to certain components.

17. Customer-Supplied Products or Third-Party Work

Where we agree to install or work with products not supplied by Habitat & Hues, we cannot guarantee the quality, suitability or performance of those products.

We are not responsible for defects caused by:

  • customer-supplied materials;

  • third-party products;

  • third-party measurements;

  • third-party installation; or

  • building or electrical works carried out by others.

18. Our Responsibility to You

We are responsible for foreseeable loss or damage caused by our failure to comply with our contractual obligations or by our failure to use reasonable care and skill.

We do not exclude or limit liability where it would be unlawful to do so.

Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • any liability that cannot legally be excluded or limited.

We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.

19. Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by circumstances outside our reasonable control.

These may include, for example:

  • supplier or manufacturer disruption;

  • transport or shipping disruption;

  • severe weather;

  • industrial action;

  • public emergencies;

  • restrictions imposed by authorities;

  • significant utility failures; or

  • other events that we could not reasonably prevent.

We will take reasonable steps to minimise the effect of such circumstances and resume our obligations when reasonably possible.

20. Your Statutory Rights

If you are a consumer, you have legal rights in relation to goods and services.

Among other requirements, goods supplied to consumers must generally be:

  • as described;

  • of satisfactory quality; and

  • fit for purpose where applicable.

Services must generally be performed with reasonable care and skill.

Nothing in these Terms & Conditions is intended to exclude or restrict those rights.

21. Privacy

We process personal information in accordance with our Privacy Policy.

Please refer to the Privacy Policy on our website for information about how we collect, use and protect customer information.

22. Complaints

We aim to provide a high standard of service.

If you are dissatisfied with any aspect of your project, please contact us as soon as possible so that we have a reasonable opportunity to investigate and, where appropriate, resolve the issue.

23. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer, you will retain any mandatory rights relating to the courts or laws applicable to you under consumer law.

24. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to your order will normally be the version provided or available when your order was accepted, unless a subsequent change is agreed between us or is required by law.
